Choosing Mediation or Uncontested Divorce on Long Island
Understanding your options as a petitioner or a couple
Before coming to Solutions Divorce Mediation, Inc., you should consider how you want us to help you. Are you coming in as a couple or by yourself? Are you starting from scratch, or have you already discussed your impending divorce with your spouse? How ready are you to move forward? When you know what you want, it’s that much easier for our trained mediators and experienced divorce attorneys to help.
What to expect from divorce mediation
When a couple schedules mediation with us, they get the benefit of our guidance in resolving their ancillary issues. Depending on the complexity of their situation, divorce mediation can take one to three meetings to resolve all issues. Our mediators have vast family law experience. They know the law and they know how courts are likely to view the facts in question. The mediator doesn’t favor one side or the other, but is candid and realistic about each party’s demands. The mediator’s goal is to get you and your spouse to a workable agreement that will serve you now and in the future. Our process affords you:
- Flexibility and control over the proceedings
- Efficiency and cost savings
- Confidentiality, since differences are resolved in private rather than open court
At the conclusion of mediation, you have a settlement agreement, which our in-house attorneys can quickly prepare for court. Once approved, the settlement you achieved forms the basis of your divorce decree.
Seeking our help by yourself
We also help individual spouses prepare paperwork to file for divorce. In this case, the would-be petitioner sees one of our in-house attorneys to discuss the terms for divorce. Some of these clients come in fully prepared, having already discussed the issue with the other spouse, and wanting only the legal paperwork to file for an uncontested divorce. This we can do quickly and economically so that you can often file the very same day. When your spouse answers the petition, he or she can approve the demands, clearing the way for the uncontested divorce to be finalized. This service comes at the low rate of $1,500 for the drafting, though there will be about $400 additional in filing fees. Rates for mediating a complex divorce start at $345 an hour, which the spouses share.
